Auto Insurance Claims: bycicle hit my car, home owners insurance, small claims court

Question
i was driving my car threw a intersection and a pedestrian on a bike ran into the side of my car he was traveling the wrong way on a one way street.he basically t-boned my car. it tore off my mirror and dented up the side of my car. if he has auto insurance do they cover any damage he did to my car or if he has home owners insurance are they responsible? and how do i go about getting them to pay?

Answer
Hi Rex-

Are you sure that he is not going to claim you hit him?  That would be my first worry at this point.  He could claim you injured him and sue you for his injuries. If it's not too late see if you can get a witness and have them write a statement and sign it.

If he admits he was at fault, you would have to take him to small claims court.  Home or auto insurance would not cover it.

Good luck
