Auto Insurance Claims: How to I fight the claim??, auto repair shop, adavance

Hello Mr. Hixenbaugh,
I have a question regarding who is at fault in my particular case and I need your expertise on insurance issue. Thanks in adavance. Here is the situation:

I went to an auto repair shop and I parked in front of the office entrance since there were no parking spaces available at the time. Came back out and got into my car and started the car that's when a mechanic was backing out a car and hit my driver side door. Insurance was filed and damage was appraised, the claim handler told me that it would be a 50/50 split. They accused me of parking in a no parking zone, which I said that I was unaware of it. Am I at fault in this situation? What should I do now?

Hi David,

It should make no difference that you were improperly parked. Any time someone backs up, they have a duty to be sure the path is clear. To the best of my knowledge, anytime someone hits a stationary object even if it is a car that is improperly parked, they are at fault. You should try to ague this point to the insurance company.
