Auto Insurance Claims: MY PARKED CAR AS NO INSURANCE IT BY STOLEN CAR, small claims court, uninsured motorist

MY PARKED CAR AS NO INSURANCE ,IT WAS HIT, CRUSHED BY  ANOTHER CAR WITH INSURANCE IN MY HOME TOWN OF PHILLY PA ON 12/23/07 THE AGENT TOLD ME THE CAR WAS STOLEN AND THAT THEY ARE NOT RESPONSIBLE,,POLICE WHERE AT THE SCENE AND MADE NO ARREST, THE DRIVER DID NOT HAVE A LICENSE TO DRIVE..I VISITED THE CAR OWNER AND WAS TOLD THE DRIVER WAS A FRIEND ...AND THE DRIVER STOLE THE CAR...I THINK SHE GAVE HER THE KEYS...AND THEN WHEN THE CAR CAME BACK FROM BEING TOWED THEY CLAIMED IT WAS STOLEN , TO THE DAY NO ARREST HAS BEEN MADE...WHAT CAN I DO....

Hi Ed-

I'm not sure if you are saying the friend stole it or a stranger stole it.  Either way there was a police report so the driver was identified right?  The driver is the person responsible here. Get a copy of the police report so you know who it is and then either take them to small claims court or find an attorney that will help you.  
It is very important to have insurance with uninsured motorist protection for cases like this one.  Your insurance company would have paid for your loss and then it would be up to them to go after whoever was responsible.
