Auto Insurance Claims: Denied Insurance Claim, dodge neon, insurance claim

I was driving to work the other day and I came to a 4 way stop with a car infront of me being stopped at the sign. When I pulled up to the stop sign, I stopped. I then proceeded into the intersection and another truck had already just rolled through his stop sign from the left. I hit the driver in his passenger door. The police were called due to the damage of the front of my car which is a small Dodge Neon, and his truck was a F150 which had very little damage to the side due to how high it was. Anyway, the no tickets were issued and I told the police what happened, but he was not very thorough. I did not hear what the other driver had said happened. When I got the police report, it stated that the accident was due to failure on my part to obey stop sign. I have liability and my insurance came out and denied his claim against him after researching the whole intersection and both cars. His adjuster told me that she denied the claim because she saw the police report. This police report was not accurate, and there were no witnesses. I had the right of way at the intersection too, because I was to his right. I do not know how the officer came to the conclusion that I did not stop. What process can I take to collect a claim from his insurance?

Hi Jeanette,

You can make the claim through your insurance company who will then try to fight with the other insurance comany to reach a settlement. Other than that, the only thing you can do is to file a law suit against the other driver. If you can convince a judge that you were not at fault and he finds the other driver at fault then you could collect from his insurance company.
