Auto Insurance Claims: parked car - Totaled, storage fee, tow yard

I have two questions

1)   My parked car was totaled. The police office said that it was policy for it to be removed and taken to a junkyard. Its been in the junk yard for the last 36 days and counting.  If the person that hit me has insurance, will they be responsible for paying the junkyard fees (approx 1,400)  
2)   My insurance All State took extremely long in providing any type of update etc…The claims adjuster in charge of my case was on vacation for 2 weeks.  As a result my claim has not been resolved and since the party at fault has not responded to 2 letters My insurance will cover the car but not the storage fee. Doesn’t the policy report provide whether or not the person had insurance or not ?

Hi Jose,

If your insurance company is handling the claim, they should have the vehicle moved to their storage fee location. If you leave the car at the tow yard the at-fault persons insurance will not pay because it is your responsibility to minimize the costs. If your insurance company is not handling the claim, then you need to pay the storage and move the car. The police report should show the insurance company. You should go to the police department to get a copy of the police report. Then you can call the other insurance company and report the claim.
