Auto Insurance Claims: Car being totaled or not, maughan, insurance company


Question
My insurance company has been undecided on whether to total my car or to repair it due to the expense of repair. Do I have insurance or legal rights to have the car totaled if I feel the car will never be right after repair?

Hi Richard-

The insurance company will only total the car if it determines that it will cost more to repair the car than to replace it.  I don't know of any way to challenge that.  They are obligated to repair it to it's original condition- it should be just as good as before the accident.
