Auto Insurance Claims: Tree fell on my car, southern california weather, costa mesa ca

I have found similar questions on this site, but wanted to ask specific
question. Forgive me if this is a repeat question that I could not find an
answer to. I had parked my car in the parking lot of an apartment complex
(private property) in Costa Mesa, CA (orange county). It was raining on Jan
4th, but I did not think it was that windy. A tree completely uprooted and fell
on my car (2005 Nissan Altima). The roots were only about 2 feet deep. My
auto insurance covers it, but I want to see if  the apartment is liable so that I
do not have to pay the deductible. I understand that it is considered an Act of
God, however, is it that common for a tree to fall in Southern California
weather? Or is it more likely that the tree was improperly maintained?

Hi Paul-

I'm sorry to hear about your car.  When your insurance pays they may decide to go to the apartment owners to recover what they paid out.  You could try to contact the apartment complex on your own and see if they are willing to pay your deductible and see what happens.
Unless you could prove the owners knew of a problem with the tree and failed to act, I don't think you'll win.
