Auto Insurance Claims: Insurance question, insurance question, parking space

I pulled out of a parking space and was all the way out and stopped. I was getting ready to put the car in drive and noticed a car pulling out across from me out of a parking space. I beeped my horn but she still hit me. Called the cops and they made a police report saying she hit me. I thought I had insurance but a big misunderstanding I didn't have insurance. Her insurance finally called me and left a message saying that the accident was 50/50 and that they are not paying me for the damages. I don't know if the store will let me but if I can get a copy of the video of the accident from the store showing that she hit me. Will her insurance look at the video and if they wont and I go to court over this. If they found out that I didn't have insurance at the time but the video shows her hitting my car and I win will they still have to pay me. Or will they say since I didn't have insurance they don't have to pay me? Or how should I go about doing this? This happened in TN.

You should absolutely pursue this. The store may not give you the video tape but they will give it to the police. Try getting it from the store and if they will not give it to you, you will have to contact the police to see if you can get them to obtain it.

The fact that you had no insurance is not relevant. If the other person is found to be at fault, their insurance company will have to pay.
