Auto Insurance Claims: Auto Insurance Claim, state farm insurance, insurance company allstate

I live in OH. I was hit by an insured driver from TN, who was driving her daughter's car (daughter's car located in and insured in OH). They both have State Farm insurance. I called State Farm in OH who told me the driver's policy in TN should pay damages.  I called State Farm in TN who said it is based on the car, so State Farm in OH should cover damages. I called State Farm in OH who now tells me they don't know who is responsible. My insurance company, Allstate, tells me the policy of the vehicle she was driving should cover the damages, thus State Farm in OH. Can you tell me who is right, as State Farm has really dropped the ball on this one and my car is still damaged. I won't be filing a claim with my insurance as State Farm has admitted responsibility, but won't send an adjuster until they determine which state will handle the claim. Thank you.

Hi Karen,

The first thing you need to know is that most claims adjusters are idiots.  You were likely dealing with someone who has been handling claims for about 10 minutes.

The correct answer is that it is the insurance of the car that would pay for your damage. Auto insurance follows the vehicle, not the driver.  So call State Farm Back and tell them they are idiots, that the claim should be paid in Ohio and to send out a damage estimator as soon as possible because you have already been inconvenienced enough.
