Auto Insurance Claims: Auto Claim, rental coverage, auto claim


Question
my daughter was hit in her car by a women who wasnt looking where she was going.since it was a private parking lot police would not file a police report.
who pays for my car her insurance?
her car had a brkn headlight my car 3000 worth of damage.
can i rent a car and have them pay.
i just need the protocal i should follow.

Hi Mark,

First you need to call the at-fault persons insurance company and report the claim. They will take a statement from your daughter as to what happened. They will also call their insured for a statement. Then they will make a liability decision. If both storied match up they should accept 100% liability. In that they will pay for all repairs and a rental car. If the at fault person gives a different version of events, the insurance company may only accept a percentage of liability. If this happens you will want to put the claim through your daughters insurance and let them fight with the other company to reach a settlement. In that case you would only get a rental car if your daughter has rental coverage on her policy. Hopefully, the other person will admit fault and all will be handled easily.  Have a happy Holiday!
