Auto Insurance Claims: Am I the cause of the accident, sarno rd, wickam


Question
I was involved in an accident on a 4 lane rd in the center lane. This was a busy time of day at an extremely busy intersection of town. I was at a Walmart plaza trying to make a left on the Noth bound lane of Wickam Rd. The two lanes of traffic yielded to me shortly after the light turned red at the main intersection of Wickam and Sarno Rd.I proceeded forward and looked in both N and S directions to see if traffic was comming. At the time I could only see so far because of the vehicles that had yielded in the two S bound lanes. When I made my move to turn left immediately I was slammed into at a speed that I estimate to be between 30-40 MPH. She was flying down the center lane and I had just barely started to enter the center lane. In my opinion and from what I understand of the FL driving laws she was in that center lane too soon because the first available turn at a Chili's was farther down from were we collided. She was in my opinion as well going way to fast for someone who had any intention of turning at Chili's. I believe she was bypassing traffic to make a left at Sarno Rd intersection. When I looked she was not there, I then turned left and was slammed. The police ticketed me and her stating that I was the cause and she was negligent as well. I don't believe it was my fault. I beieve if she was obeying the speed limit that we could have not only avoided the accident but I would have had additional time to yield to her. What do you think?

Answer
I think any time you get a ticket at the scene you will really have a hard time fighting it.  The officer was on the scene and heard both sides- so it's really hard for someone else to override his decioion.  I don't know about Fl. but in Ca. if the insurance company agrees that each is 50% at fault then the accident will not count against you and your insurance rates should not go up.
