Auto Insurance Claims: Rental car and deminished value, porsche cayenne, comparable vehicle

I was driving my 2004 Porsche Cayenne and was T-boned by someone who ran a stopsign.  My car has been in the shop for over FOURTEEN months now, with payment of the rental car coming out of my pocket and repairs totaling $36,000.  I've been given excuses of parts on national backorder, wrong part deliveries, sick workers, etc. from the body shop.  I am so confused on what I am entitled to.

I was told that I am entitled to equivalent value of rental of a Porsche Cayenne ($200/day), is this true?  Also, will I be entitled to diminished value to my Porsche with $36,000 in repairs to a $45,000 car..?  I need help with this record-breaking time of repair..Thanks, Eric from Fresno

Hi Eric,

As far as the rental is concerned; you are entitled to a "comparable" vehicle. Unfortunately, in the eyes of the law the word "comparable" means same function and utility. I am very famaliar with your vehicle. Essentially any mid-size SUV would be considered a "comparable vehicle". If there are any time periods that you did not have a rental vehicle you will be entitled to payment for loss of use. This is a cash payment per day for each day you did not have a rental car. Generally the amount would be between $15.00 to $30.00 per day.
