Auto Insurance Claims: My brother crashed my car!, car insurance company, own car

I am from Massachusetts and My brother just returned home after living at his own place for about 3 years on his license it still says he lives with me at my current address he has his own car insurance company. Anyway he was he borrowed my car and got into a hit and run accident which was taken care of when he called the police after he returned home in my car. So he called his insurance company and was trying to file a claim and he was told that i had to contact my insurance which seemed reasonable. When I talked to my insurance and was informed that the surcharge would go against my insurance as well as his is this true that they can do that double surcharge for one car accident?

I'm assuming your brother was at fault in the accident.  If he was, then both insurers will consider this information for rating purposes.  This is not a double surcharge.  Each insurer is simply rating the risk posed by their respective insured.  If he committed a hit and run and was at fault, that is pretty serious.  His insurer needs to know that they are taking on the risk of someone who did that.  And your insurance now knows that someone who did this may use your car again.  That is a lot of risk for them to assume.  Now you could choose to exclude him from your policy and that will lower the risk and the premium.  But if you choose this option, you must make sure he never uses the car, because there will be no coverage at all if he does.

Your policy is primary for covering the accident.  His policy would only apply if you had no coverage on your car.
