Auto Insurance Claims: Being sued over an accident that happened one year ago!, statue of limitation, injury report

Question
I was involved in an accident a year ago where I rear ended another vehicle. There was hardly any damages to his car. Now this guy wants to sue me, saying that his injuries are very serious and he can't work and may need surgery. He only filed claim to fix the damage to his car.  He did not file a personal injury report at that time, and there was no police report.  I know he's lying because he was walking around getting info right after the accident, and showed no pain. Can he file a claim after one year of the accident since he is still within the Statue of Limitation in California?  What proof is there that his current injuries are related to the accident?  And what are the chances of winning the lawsuit?  Also, my insurance company has sent a form asking me to fill out an approval to disclose the amount of my coverage to the claimant.  Should I sign this form?

Answer
Hi Renna,

Yes. They can file a law suit right up to the last day of the statute of limitations. You should be working very closely with your insurance company. If you have received suit papers you should turn them over to your insurance company. Your insurance company should assign a defense attorney to you to handle the suit. You should ask your company to provide you with the name and phone number of their attorney that will habdle your case. Any questions regarding the suit should be directed to that attorney since they are the one responsible for defending your case.  They should also be able to tell you if you should sign that form.

I hope this helps
