Auto Insurance Claims: 3rd party at first claimed liability - now saying my fault!, own insurance, law suit

Question
Hi
I had a car accident 4 wks ago where i ws going round a roundabout taking the 3rd exit. A lady joined the roundabout and hit me as she was going faster than me and didn't see me. She immediately apologised and even asked what happened as she didn't see(!) I explained and she again apologised. Her insurance phoned and admitted liability. Fine I thought. Have now just heard that she is claimimg the accident is my fault! There are no other witnesses. Can you please advise? Is this just going to be my word against hers?

Answer
Hi Heidi,

Unfortunately yes. It will be your word against hers. You should call her insurance and remind them that they had already accepted liability and that if they do not pay your claim you will file a law suit against their insured. But if you say that be prepared to do so.  You can also put the claim through your own insurance and they will try to negotiate a reasonable settlement with the other insurance company.

I hope this helps
