Auto Insurance Claims: tire blowout, tire blowout, lengthy litigation

My front right tire blew out and caused me to swerve into a parked truck. The tire had a warranty so is the company that sold me the tire at all at fault for the damage to my or the other person's car?

Hi Liana,

No. The tire manufacturer may be liable if the tire was actually defective. But if the tire blew out due to a road hazard such as a nail or glass they are not liable for that. If it was due to a defective tire you would have to involve an attorney, testing labratories to determine the exact nature of the defect, then a very lengthy litigation process.  You may be better off to just let your insurance company handle all of the damage.
