Auto Insurance Claims: he wont talk, pepper spray, mothers name


Question
The other weekend I was in Tulsa coming home from a concert, when I was in an accident. I had two witnesses, who stated that the other person had run a red light and, that the person didn't stay at the scene, but took off to a convince store to wash pepper spray from his eyes,(he had been kicked out of a club or something). I filed a claim with his insurance the problem being that the insurance was in his mothers name and they will not settle until the son gives a statement. That was last Friday. How long should I wait and what actions should I take after that?

Answer
This guy will never likely cooperate which will give the insurance company the legal right to deny the claim if they wish.  He sounds like the kind of person that just doesn't care.
You can wait as long as you are willing to, but if it were me,
I'd go ahead and file with my own carrier and let them fight it out.
