Auto Insurance Claims: insurance question, fault the police, insurance question

I live in California and I was in an accident a few weeks ago where the other driver was at fault.  There is no question of who was at fault...the driver himself admits fault, the police officer who took the report says he was at fault, and there was a witness who says he was at fault.  I, however, was driving with a suspended license and no insurance.  I have since gotten my license back.  It has been a month since the accident and my car is still sitting waiting to be fixed.  My question is...Since I have gotten my license back, am I entitled to a rent a car from his insurance company?  Also, do they still have to pay the damages to my car?

Hi Jennifer,

The fact that you did not have a license or insurance has no affect. The at-fault driver or his insurance company is still responsible for your damages including a rental car.

You should call his insurance company an make a claim. There is no need to eve tell them about the other issues.
