Auto Insurance Claims: Private property fender bender, fender bender, police report

I was involved in a fender bender on private property.  I was parking my car and pulling into a space when a lady backed out of the space down from me on the other side and hit me on the right back panel.  I saw her coming but could not get out of her way.  I blowed my horn but to no avail.  The damages to my car are estmated at 2000.  Her insurance company is refusing to pay.  They are saying this was 50/50.  Ihave a police report stating the woman did not see me and that she hit me.  I only have liability and my insurance can't fix my car.  What can I do?

Hi Rachel,

Unfortunately there is not much you can do. The insurance company does not have to consider the policy report since it is only based on what you and the other driver told the officer.

Unless you are willing to file a law suit, you will likey have to accept the 50/50 liability. Take the $1,000.00 and have the vehicle repaired as best you can .
