Auto Insurance Claims: Property Damage Claim, insurance limits, expensive cars

I was in an accident in which I was the one ticketed. I didn't have my car covered, so I lost it, but the other person's car repair (they say) exceeded the $10,000 that my policy covered for property damage so they are making me pay the difference. I saw the car and the damage does not seem that much, therefore I was wondering if there's is any way for me to find out if the cost of the repairs are right or if they are trying me to pay more or something that might not be even part of the accident, I called my insurance company but they refuse to release any type of information therefore I called different lawyers but they only specialized in PIP claims so they couldn't help me .... do I have any legal rights that would allow me determine if the difference of the costs is truly my responsibility or not..... there something that I could do about it?

Hi Sandra,

You are responsible for paying any amount of damage you cause that is in excess of your insurance limits.  However they will need to provide proof of what the total costs were. You should ask them to provide you with a computerized detailed repair estimate, a paid bill and a copy of any checks used to pay the bill. This information can be obtained either from their insurance company or the body shop that did the repairs.

You should also consider increasing the amount of your property damage liability coverage to at least $50,000.00. There are a lot of very expensive cars out their.
