Auto Insurance Claims: No-Fault Accident, insurance info, police report

Hi I have a very important question...I was in an accident two weeks ago. No police report was filed and we decided just to fix our own damage. Well the lady who I got in an accident with recently called me and said I have to pay for her damage, I said no. She then went to insurance with the accident. My question is if there was no police report does it become a no-fault accident? Or will insurance still have to battle it out?

Hi Nichole,

The insurance company will do a complete investigation.  They will likely take recorded statements from both of you. They will send out an inspector to take pictures of both vehicles to analize the damage and will then make a liability decision.  If they determine that you were at fault, they will request that you pay for the repairs.  If you do not pay or provide insurance info, they will likely file a law suit against you.  There is no such thing as a no-fault collision.
