Auto Insurance Claims: rearended in company vehicle, personal injury protection, rearended

Question
A coworker was provided a truck to drive and allowed to take it home as part of his compensation. He was rearended on his way home. Our employer tells him his personal insurance would cover any injury because he was headed home. On another occasion I hadn't heard about an employee was injured when as a passenger he hit his head on the cab roof when the truck bounced. The employer said as they were on their lunch hour he'd have to go to his(employee's) insurance. I don't believe this is correct. One manager says this is because of no fault in KS. It is either the insurance covering the vehicle or the insurance covering the other involved vehicle, right?

Answer
Hi Steve,

If you live in a state that has (PIP) Personal Injury Protection, you would generally go to your own insurance first. I am not specifically aware of the coverage in Kansas, so I would not be able to answer specifically.

You should ask this question of a Kansas Attorney that specializes in auto accident claims.

I hope this helps
