Auto Insurance Claims: Does ticket affect my settled claim?, subpoena, aj


Question
I was rear-ended in October and my claim against the person who hit me was settled a month later. Now I am receiving a subpoena to appear in court because the person who hit me is contesting their ticket. I was told that if I don't show up that the charges will be dismissed. Would this have an effect on my claim even though it’s already been settled & paid?

Hi AJ,

No. The ticket is just one aspect that indicates fault. When you filed your claim, the adjuster took information from both you and the other driver and then made a liability decision based on those facts. The ticket is an indication that someone broke the law, however, you do not need to receive a ticket to be found to be liable for the collision.  However it would be a good idea to show up just to have everything done properly.
