Auto Insurance Claims: Bodily Injury, bodily injury liability, soft tissue injury

Hello Richard,
 I was hit from behind a couple of months ago which caused damages over $7000. The insurance company of the person at fault did not finish paying the rental amount, stating that it took long for the repair shop,now about $300 has been withdrawn from my account by the rental company. Also I have sent them a demand letter but the adjuster is saying I only had soft tissue injury, and offering me only about $1500 after medical bills with no future medical bills or pain an suffering compensation. My medical bills with loss wages are over $6000. The adjuster said I should go get a lawyer because they will not go higher and since there were two other people in my car, and their insured has max of $20,000 on her liability to be shared between the 3 of us. I reside in the state of Texas and believe liability should be more than the amount she states for 3 people. The adjuster made 2 offers the same day and this is the 2nd one. The police report states clearly that their insured is at fault. Please advice me on what to do here, and how much do you think I should settle for.

Hi Murphy,

You should never count on an insurance company to do the right thing. The only thing they car about is keeping their money.  

In Texas, the minimum bodily injury liability limits are $20,000.00 for each person up to a total maximum of $40,000.00 for each accident.  So you can see that they already did not tell the truth.

With $6,000.00 in medical expenses, you should be look at a settlement of $12,000.00 to $18,000.00 or possible more. I would suggest that you do contact an attorney. There too much at stake here to mess with.
