Auto Insurance Claims: insurance company adjuster, company adjuster, drunk driver

hi-i was rear-ended by a suspended lisenced drunk driver. my insurance company told me to take the cat to dealer where they have an office and they will get the car fixed. within 2 hours  the car being there they called me and told me it was a loss. i was just wondering why we went through this whole ordeal of setting an appt. and giving me a rental when they can plainly see that the the car is almost 12 yrs old and we both looked at the damage together and if i can see that the damage was going to be costly why could n't he?  also the driver of the other car also has the same insurance company. are they covering their butts for a reason? do i have any say in this matter?    belinda

Hi Belinda,

Unfortunately not.  If the cost to repair the vehicle is more than 75% of the vehicle's value is is a total loss. The will pay you for the value of the car and then they will sell the car for salvage.
