Auto Insurance Claims: Auto Accident not giong through insurance, minor fender bender, auto accident

Question
Had a very minor fender bender at night. Both agreed not to go through insurance but exchanged information. few days later had had a crack in his bumper I told him to go to my auto body to get an estimate in writing. He did and then told me he wanted a "NEW" bumper even though he was told it could be replaced. Am i correct in saying if i was to go through the insurance, they would repair the bumper before replacing it! also, any advice you can give me as to how to proceed.

Answer
Hi Michelle,

Yes, you are correct. If the bumper can be properly repaired, then you only owe him for the cost of the repair, not replacement.

You should explain this to him and if he is not willing to settle, tell him that he can discuss it with your insurance company.  If he does agree, you should have him sign a "Release of All Claims" form before you give him a check.

I hope this helps
