Auto Insurance Claims: accident with uninsured motorist, repair vehicles, oncoming traffic

I was exiting a parking lot. I was at the stop limit line with my right blinker on.my view to the left was partially obstructed by street repair vehicles. I waited for traffic to clear then started my turn, not seeing the car that squeezed between my truck and the curb. I have insurance the other guy does not. I was at the stop first and there is no right turn lane marked. Only one lane going in and one lane going out. Can this guy sue me for damages to his car when he did not have any business getting between me and the curb? I am in California. I reported it to the DMV, he did not. My truck is eight feet wide in the back and due to the angle of the exit I would not have been able to see oncoming traffic, because of the partially blocked view, plus the rear of my truck being wider than the front, I cannot "hug" a curb making a right turn without running over the sidewalk.

Hi Ellen,

This is a very difficult situation to determine.  You should report tyhis to your insurance company. They will do a liability investigation to determine who was at fault and will handle accordingly. I do not think this will end up in court, but, if you do receive suit papers you should notify your insurance company immediately.
