Auto Insurance Claims: Accident with a rental car, rinky dink, month old baby

I was rear ended by a person driving a rental car from a rinky dink Vegas agency. The agent has told me that he will not file the claim on his insurance because there is no damage to their car and he cannot validate that it happened, even after previously telling me that he had confirmed the facts with the driver. He is also blaming his noncompliance on the fact that the police were not called to the scene. It was a small rear-end accident (during rush hours on a Friday on a Friday and a month old baby in the other driver's car), with only damage to my car and a bent license plate on the other. However, when asked to file an accident report by him post-accident, I did it. Now, I cannot get a hold of the driver (surprise).The insurance is through the  rental agency. Not sure if he is self-insured or not. I cannot file a claim with my own insurance because I do not have collision coverage. I have been told that m next step is to file a complaint with the DMV and to find out who his insurance carrier is. Is this information correct? Do I have a leg to stand on and go after this guy? This crap seems seriously illegal that he is doing.

Hi Marcia,

I'm really not sure where the problem is here. If there was no damage to either car and there were no injuries, then there is no claim to be made. However if there is something that I am not aware, you should do the complaint with the DMV as you mentioned to see if that will help you obtain the insurance company information.
