got in to accident was not my fault my insurance denied him? now he's taking me too small claims $3,200 private parking lot and no police report... my insurance denied him? being his fault his witness stories didn't match what happed now going to court if i lose will i have too pay? or is my insurance going to? thank you for all your help in this matter,David

Hi David,

You need to be sure that you give your summons to your insurance company ASAP.  Then thereafter you have to cooperate with the company as it defends you.  

Failure to do either of those two above could mean that you might have to pay.  

So, just cooperate with your insurance and let them take care of defending you.  That is why you bought insurance.   If they lose the trial, then they will pay.  You will do nothing to hire an attorney, and they will petition to remove the case to a court where their attorney can appear.
