Auto Insurance Claims: sons totalled vehicle, one of the girls, release of liability

My son was at church yesterday and two girls asked him if they could drive his truck.  He said "are you crazy" and started walking to the church.  The girls jumped into his truck and long story short, one of the girls hit a cement pole and totalled his truck.  When the police and ambulance were there, my son did not tell the police that he did not allow them to drive the truck, and a citation was issued to the driver for 'reckless driving'.  He had left the keys in the truck.  And one of the girls had driven his truck before, and thought it was okay.  Thankfully no one was injured badly, but my question has to do with liability.  The truck is registered in my name as well as the insurance policy.  The truck only had liability coverage and the damages to the truck are more costly than the truck is worth.  The pole that was hit was a county pole with a light and is probably going to cost my insurance company an arm and a leg.  Are we going to be responsible for medical liabilty for the girls who needed xrays and ems?  I will be having a sit down with the girls father and I want to know legally who is going to be responsible for this accident.  Any advise you can give would be great.

Hi Shirley,

You sound like a nice person. However, in this situation you need to protect your self. When you have the sit down with the girls father you need to have a paper ready for him to sign. The first part will be an adnission of responsibility on the part of his daughter, the second part will be an admission of responsibility and agreement to pay for the cost of repairs or replacement of the truck. The third part will be a release of liability for any and all injuries and any costs for the injuries to the daughter.

If he give you any problem about signing it, tell him that you could have had his daughter arrested for stealing the truck and that if he does not sign you will go to the police to ammend the policy report.
