Auto Insurance Claims: rental car after collision, insurance companies, rental car

I was involved in an accident on 12/22/06. I was the third car hit in a three car accident.  My insurance will not cover the cost of a rental.  I have tried to contact the adjuster of the at-fault party twice without success.  My car received significant damage and is not drivable.  Do I need to contact the adjuster in order to rent a car or can I do that on my own and safely assume they will cover the expense.

You would be responsible to mitigate your damages which means that if you need a rental car for transportation to avoid other expenses such as lost wages, rent the car.

Find out from the rental agency what the insurer reimburses and go for that vehicle.   Based on the loss facts, I wouldn't expect that anyone would assign liability to you.  However, there may be a liability dispute between two other insurance companies depending on what the other two drivers have reported.  Either way, you'll eventually get your money back from someone.
