Auto Insurance Claims: new car damage, preferred shops, brand new car

I have a brand new car. A deer ran into the side..causing moderate damage. Is a deductable appliable in this situation? Do I have to settle for the companys suggested repairs or can I choose who fixes my vehicle?

This be considered a comprehensive claim and whatever deductible that you chose when you purchased the policy will generally have to be paid.  

Deductibles have nothing to do with fault.  If you use your policy, there is generally a deductible.  If someone else runs into you and as fault, then you would not pay a deductible as that person's insurance would pick up the bill.

However as most of these dead beat deer won't get insurance...

You can likely choose any shop that you wish but keep an open mind if they recommend a shop.  With very few exceptions on very high $$ cars, body repair is not brand specific.  Some of the best shops may be dealer branded, but some of the worse shops are as well.  The insurer's preferred shops have to do very good work as the insurer must back it up for  as long as you own the car.  You'll also get the car back faster.
