Auto Insurance Claims: daughters car accident, insurance adjusters, collision coverage

My 18 yr old daughter was involved ina car accident. Her car was totaled(She had a 20 yr. old car) She was taken to hospital by ambulance luckily she has no seriously injured-mild concusion. She was given a citation. Failure to yield right of way. Athough It was very foggy and the other car didn't have their headlights on.(Is written on police report) We don't feel this was all her fault. We don't have collision coverage but we do have medical coverage. Do we wait for the insurance adjusters call us or do we get an lawyer?

I'm sorry your daughter is going through this. I hope she will be ok.

Unfortunately, there is not likely much you can do in this situation. If she was cited for the collision, she will be considered at fault. Even if the other driver did not have on headlights, it will be mostly considred your daughters fault. Even if you were able to convince them that the other person was 25% at fault, they would only be responsible for paying for 25% of the value of the car and at 20 years old was maybe only a couple of hundred dollars. But your daughter would still be responsible to pay 75% of the damage to the other car.  It would not be worth your time or money to hire an attorney because the outcome would be the same.
