Auto Insurance Claims: unoccupied parked vehicle struck by drunk driver, rental car business, police accident report

my 2004 Ford Taurus was struck from behind while it was parked, along with another unoccupied vehicle, in a private parking lot, the driver of the vehicle that hit both cars was taken to jail, he was cooperative with the investigating officer,and in the police accident report it stated he had a BAC of.236 and was charged with DWI,no one else was cited, , all the vehicles had to be towed from the scene,I contacted his agent and filed a claim against his policy, it took 2 days before they were able to contact the policy holder, the owner of the other vehicle, that was struck as well as myself had to wait until their policy holder gave his statement,regardless of the police report,and we had to go with out transportation until the claim was turned over to adusters, we both have different adusters,but were sent to the same rental car business,the lady whose truck was hit received a late model Dodge Ram w/crew cab a real up grade from the truck she had prior to the accident,I was given a 2 door colbalt, in lieu of my 4 door Taurus, I contacted the adjuster the next day and was upgraded to a "06"  pontiac grand prix, which is more acceptable, however I am concerned  about being billed for this rental car,  as well as the  $35.00 daily storage fee. on my intial visit to the rental agency, I was asked for and I gave my debit card # I was told they would only take a $1.oo out of my account,and so far this is true, the insurance co. is moving to slow on this for me, while the storage and other rental is adding up, the adjuster still has not assessed my vehicle, I was told by others at the accident scene that my vehicle was totaled, but have yet to here this from the claims adjuster I would like to move on, and start looking for another vehicle, they have already accepted responsibilty, are they going to try to stick me with the storage cost as well as rental, I also worry about being low balled on compensation for my vehicle, any suggestions or advice you can give is appreciated

HI Scott,

First of all you must keep in mind that you are the victim here. The insurance company of the drunk is responsible to pay for all costs and expenses associated with this claim. If they try to stick you with any storage charges, you simply agrue that it was due to their delays.

As for the value of your car, you should check 4 websites as follows:
1) www.nada.com
2) www.kbb.com
3) www.edmunds.com
4) www.autotrader.com

By checking the retail value of your car on each of these sites and developing an overall average, you will then be able to determine if the insurance company's offer is fair.
