Auto Insurance Claims: Auto accident, ocurred, insurance info

on November 17 2006, i was hit in the rear of my car by a company vehicle (roto rooter truck). We didnt call the police, but we did exchange information. He said the company he worked for would pay for the damages. So he gave us a number to call. Well later that day we called the number and we had to leave a message to have someone call us back. Well when the owner called back they calld blocked. She tried to scare us assuming that i didnt have a license or insurance (but have both) she claimed that they had filed a police report and that we had to go sign it. Well a couple days later we called the police department in the town where the accident ocurred. And askd them wat we should do. and they looked to see if the company filed a report. Turns out they didnt so they lied to us. The next day we went and filed a report. And the officer who took our report contacted the company. The company said that we ran from the scene and didnt stop at the time of the accident. Well we have our phone records showing we calld them the day of the accident. we have there names, company name, number, all given to us by the driver. so i mean we have pretty good evidence showing we stopped. we were given their insurance info by the police. we calld their insurance agent and he said that they hadnt reported the accident to them. So what should i do?

Answer
Three choices.
File with their insurance company.
File with your insurance company and let them pursue the at-fault party.
File a suit in small claim's court.

If it were me, I'd take the second choice, let my carrier do the work and go on with life.
