Auto Insurance Claims: Can I still file insurance claim?, mail return receipt, certified mail

While exiting a parking area, a pick up truck backed out and into my car as I was passing behind it. Driver says he did not see me. Damage was to right passenger door. Asked me not to go thru insurance company. That he would pay for repairs. It's been one week since the accident and still no payment, even after securing two repair estimates, as he requested. An amount which he did originally agree to. I don't want to keep waiting. How long before I can no longer file a claim under California law?

Hi Charlene,

You should report a claim within a "reasonable" time. If it has only been a week or so since the accident, you are just fine.

I would sent a letter to the at fault person by certified mail/return receipt requested, demanding payment within 10 days or you will file the claim with his insurance company.  Then if he does not pay, file the claim.
