Auto Insurance Claims: Auto Accident w/ DWI, diminished value, drunk driver

My wife and son were rear ended by a drunk driver. Both had injuries. My son just a trip to the ER. My wife a trip to the ER plus rehab. Total for both was around $5000.00. The car had just over $10,000.00 in damage. The other driver was sighted with DWI, failure to control speed, and no drivers license. How big of a settlement should they be looking at?

Depending on the severity of your wife's injuries, she should be looking for 3 to 10 times the amount of the medical bills. Your son should receive at least 2 times the ER bill.

As for your vehicle, if it is repairable you will be entitled to the cost of repairs, a rental vehicle or loss of use during repairs and payment for the diminished value of your vehicle.  With over 10k in repair cost the diminished value or loss of market value could be could be 2k to 5k.
