Auto Insurance Claims: Can they dispute the police report?, motorcycle accident, police report

Hello,
I have a question regarding the motorcycle accident my husband was involved in. A car pulled out in front of him from a gas station, and he was on the main road. He didn't actually hit the vehicle that pulled out in front of him, but by him avoiding the vehicle, he did lose control of the motorcycle and laid the bike down. It was stated on the police report that the vehicle that pulled out in front of him didn't yield to right of way to my husband. And it also listed a witness on the police report who saw this. I am now trying to file a claim with the other vehicle's insurance company, because we feel that it was their fault for failing to yield right of way. Can I actually do that? And is it true that the other insurance's company can dispute the police report? They are actually saying that the police report is not valid?!

Hi Joanna,

Yes they can dispute the police report. But you should go ahead and make your claim. Let them come back with a written denial of your claim. The you would have file a law suit against the at fault person. You will need to bring the witness to court to testify.  If the judge determines that the other person was at fault then the insurance company would have to pay your husbands medical bills and other expenses.
