Auto Insurance Claims: DUI Accident: Auto-Insurance Claim, state insurance commissioners, auto insurance claim

Hi Richard,

I recently met with an accident while driving under DUI. It was other party's fault and police report also states the same.

My insurance coverage is liability so my insurance company will not pay for the damage. My insurance company placed the claim to other party's insurance company since it was other party's fault. But they refused to pay me as I was driving under DUI. Together with that my insurance company also refused to pay other party as police report says it was other party's fault.

Kindly let me know if my claim for the damage to other party's insurance company is valid. There was an accident with damage to both cars and none of our insurance companies are paying the claim.

I will highly appreciate your response.

Hi Abhi,

This is a difficult situation. Although you were not at fault, the other insurance company is likely trying to place some of the blame on you due to the DUI.  You should request thet the other insurance company provide you with a written statement of exactly why they are denying your claim. Then based on the response you can decide what to do. You may want to file a complaint with your state insurance commissioners office, or, you may need to file a law suite in small claims court. If you decide to file suite you should consult with an attorney in your area.
