Auto Insurance Claims: being sued for everything, drunk man, court dates

My husband hit a drunk man while he was reeling across the middle of a street (not at an intersection, and it was dark).  His car was barely moving at the time, and the man was apparently not hurt that badly.  He was walking around and fine afterwards (my husband stopped, waited for the police, got him help).  The man reeked of alcohol, which the police noted in the report, and he was brought to a hospital.  Over a year later, the man (whom I highly suspect isn't a legal citizen, and who speaks NO english at all) sues us for everything - all our money, our house, our cars, everything.  

Our insurance company is handling it, and court dates get set and then get cancelled, and so on, for a few years now.  Now it's going to trial, supposedly, in a few weeks.  

I'm having panic attacks, my chest is hurting, I can't breathe, just thinking about this.  Can this man really win everything we own?

Hi Nina,

Considering the man was drunk and was in the middle of a dark road all plays in your favor. Your insurance company provided attorney should argue vigorously against any liability on your husbands part. Hopelully he/she has put together a good case and can win.

Unfortunately, in car verses man situations the judge or jury may feel sympathy for him and award him something.  This is one of thse situations that you just have to wait to see what happens. Based on what you have stated though, I don't thing you have too much to worry about.
