Auto Insurance Claims: Stolen Car, uninsured motorist coverage, car thief

Hi,

What are my rights when I was hit by a car that was stolen? Do I go after the driver or the actual owner?

Answer
Generally speaking, liability insurance only covers permissive use.  Hopefully you have uninsured motorist, but if you do not, your only recourse is to pursue the driver personally.  If this driver has insurance, it will not cover losses that occur in the commission of a crime so that is out as well.  Wouldn't matter much as I've never seen a car thief with insurance anyway.
