Auto Insurance Claims: additional claim, acura integra ls, radiator replacement


Question
I'm sorry I should have included it's a 2000 acura integra LS 1.8. with 90,000. If problem was not there before accident. Shop can tell them could have been caused but cannot say for  sure it did or didn't, but neither can insurance company.  I do not want to be paid for something not caused by wreck but also want company to be fair with me.

My daughter was hit and push into a deep pot hole.The insurance company paid for body damage and paid half on radiator replacement it had hair line crack.The problem is we picked her car up from body shop so she could drive on to school (college) she was on interstate about 10-15 miles from body shop the oil engine lights etc.. start flashing she hears a loud pop smoke is coming out heavy from engine a tractor trailer runs up close behind her thinks she going to get hit a piston when through block. Question is we have maintance records of service there was oil in engine when towed to shop. There where no prior noises or problems with car before wreck.Is insurance company responsible for all or part of cost of replacement of engine  $2500-$5500 and also rental car for my daughter?

I may be wrong, but it sounds like this is an older vehicle with many miles on it.

In order to get the insurance company to accept responsibility for this, you will need to get a mechanic to diagnose the exact cause of the problem and to be willing to state that it is the direct result of the accident. You will need to do this at your own expense. Even if you are successful with the above, the insurance company will only pay a prorated portion of the costs based on the vehicles mileage.

I understand, but that's just the problem. The burden of proof is on you.  Unless you have someone that would be willing to testify in court and can prove a connection, the insurance company will likely deny it.

You should try to make your best argument and see what happens. This is a tough one.
