Auto Insurance Claims: Auto Accident Insurance Claim, insurance auction, accident insurance

I was inlvolved in a an accident that was the other persons fault and i have been going through there insurance company for my settlement. I was wondering since it has been like a month now and I am still trying to get everthing together such as my medical bills, loss of wages, ect. That should I settle on the property damage part of the claim right now and then settele the rest or personal loss part later because the insurance company is telling me my car is occuring storages fees that I am going to have to pay when they have already moved my car to an insurance auction becuase it was totaled. They also had moved the car without my knowledge. What is the law on that ? Just wondering if I have another week to wait for all my info to send in on the whole claim or should just settle now on the property damage side of things?

Hi Brian,

It would be just fine to go ahead and settle the property damage claim now and the injury claim later.  Just be sure that if they require you to sign a release form in order to get paid for the property damage claim, that is is only for the property damage. If there are any words in the release form such as; "any and all claims", "all claims", "bodily Injury" or any thing like that do not sign the release. It should clearly state in large print at the top PROPERTY DAMAGE RELEASE. If it says anything else, don't sign it. It is also possible that they will not even ask for a release, so don't bring it up unless they do.  They will require a release however for the bodily injury claim.
