Auto Insurance Claims: suspended license but not my fault, sr 22 insurance, fault the police

Hi,
I have to have SR-22 insurance on my car until next year and I recently moved from Nebraska to Georgia. When I tried to pay my monthly insurance premium over the phone and update my address, I was told that I could not have that insurance because I lived in another state. My insurance subsequently lapsed last month and my licensed suspended.

I had not yet bought a policy through a new insurer or had my license reinstated when I was in an accident that was not my fault. The police report states it was the other party's fault and I did not get a ticket. I'm assuming the Georgia police did not know my license was suspended with Nebraska. I do not yet have a license with Georiga.

My question is would the other party's insurance be liable to pay a cliam to me and/or pay for a loaner car or am I out of luck because I don't have insurance and my license is suspended?

Hi Jacqueline,

The fact that your license was suspended and you had no insurance, makes no difference.  If the other person was the cause of the damage then they are liable to pay for it, or have thier insurance company pay for it.

I would advise you to get you insurance and license situation corrected as soon as possible.  Georgia is very strict abouth these things and you could end up in jail.
