Auto Insurance Claims: who is at fault?, independent witness, insurance agent

Sorry to be so needy... but a couple more things.  There was no damage to my friend's car, in which case she will not be asking for anything to be reimbursed for the damages.  However, our main concern is that the man who hit my friend is so adamant that she backed into him that he will not settle for having to pay his own damages.  In that case, can he file a contest against the decision and do you think that it will go anywhere if he does?  Thank you so much for your help.

Question -
a friend of mine was in an accident a few weeks back in which she was in a parking lot going straight and was slowing down to turn right when the car behind her hit her.  the person behind her is saying that she was in reverse and backed into him, while she is saying that she was slowing down to make the right hand turn.  each person is insured and has contacted thier insurance company, who are supposed to be determining fault.  my question is, with such conflicting statements and no witnesses besides the other person in the car with my friend, how will the companies determine fault?  the man in the other car seems sure that my friend backed into him, but there would be no reason that she would be backing up at all.  my friend's insurance agent has made the statment that it doesnt make sense to her that she would be backing up.  neither party was injured as far as we know.  any suggestions/comments about fault would be much appreciated.  thank you.

This is one of those situations where no one will be happy with the outcome.

Without an independent witness, it is unlikely that the insurance companies will make a liability decision.  They will probably just agree that each person should take care of their own damage.

In this case, it is basically, he said/she said. Without any proof or a witness it is unlikely he would win. Your friend should also remain adamant that she was not backing up and should insist that her insurance company not pay anything.
