Auto Insurance Claims: Auto Claim, state insurance commissioner, horace mann

I just bought a new Pontiac G6 a month ago. On sunday a seventenn year old kid hit me....i have picked up the police report and it says that files were charged on him for FTY ROW from a private drive.....
I have filed a claim with his insurance company Horace Mann....and they have since left me in limbo until they contact their client....
Can they not assume liability since it was his fault?

Dear Sandy,

NO, the insurance company will never pay you a dime until they get to hear from their insured about the accident.  That is just how it is, and rightfully so.

What can you do about it?

First, you can just use your own company to do the repairs and let THEM worry about collecting from the tortfeasor's company.  Of course you will want Horace Mann to pay your deductible.

Ask them go make the other company put some horsepower on getting in touch with their insured.
