Auto Insurance Claims: car park accident, juris doctor, i don t care

hey,
my car was parked in a no parking/loading zone out the front of work the car was being loaded when a car in the parking lot reversed into it now i just wanted to know who was at fault... its very common for our employees to park there or though we re probably not supposed to

Dear Ben,

I don't care if you were blocking the driveway itself, the car doing the backing has the burden of making sure the area is clear before he moves into an area.  

It is his duty to yield the right of way to every other vehicle. He has the burden to make sure he does not hit anything, and what could be his excuse for hitting your car?

I hope he is not saying that he relied upon the no parking sign because that just won't wash.  Whether or not the cops can ticket your car for being there is irrelevant.  What, he is going to say that he has free license to hit anyone parked illegally in the city?  See how dumb his argument would be.

Bottom line: he pays 100%.  Period.  If your car was there to be seen, then it is his duty to see it and to avoid it.
