Auto Insurance Claims: auto claim, cracked windshield, auto claim


Question
We own a '95 BMW and it was insured through Farmers'.  At the time it was covered under our policy, it sustained a cracked windshield.  Also, the back left window shattered (windows are electric; husband was putting it up).

Because we weren't using it, we cancelled the policy.  But now, due to certain financial situations, we need to use the BMW again.

My insurance company said they would not cover a claim for the windows now, even though the car was covered when the damage occurred.

Are they allowed to do this?   Thanks!

Appears by not reporting the incidents when they occurred to your then insurnace carrier that you have painted yourself into a corner.

The company (Farmers) has ever right to question the loss(es) given the fact that you did not report it at the time.

Do you have any way to demonstrate that one or both incients occurred prior to your cancelling the policy?  Did you mention it do your agent at the time?

If you have no way to document/demonstrate that either incident occurred within the policy term then I fear you are SOL.

If you could demonstrate that the incidents occurred within the policy term you would still be looking at two different Comprehensive (COMP) deductibles as these are two unrelated incidents/occurences...
