Auto Insurance Claims: Whos at fault, nissan sentra, lane traffic


Question
I was driving west bound, I m on a right lane traffic, all the vehicles on the this lane were stopped or not moving at all, the traffic light is on front of us. I  wanted to go to my left lane, when I checked, there was no vehicle, no traffic at all, it was free. So I decided to change lane and get out of the traffic (I'm still towards or going west bound), when I moved my car to the left lane another car was coming from my behind and hit my left head light which causes to scratch my left side bumper and got my Headlight totally out of place, my headlight was unattached now from my vehicle. The damaged caused to the other vehicle was a scratch on his left side of the doors. His driving a 2002 nissan sentra and I my car is a 1998 Acura 2.5 TL.  My question is :Is it my fault?

I used my signal light prior to changing lane and from a stopped state, I am only moving maybe approximately 5-7 m/hr.

From what you relate it does appear as though you are at fault.  It appears as though the other vehicle was in "possession" of the left lane when you started to move into that lane.  Whether that vehicle was behind you to start with is irrelevant.  The physical damage is damming.  Sorry for the bad news.
