Auto Insurance Claims: 50/50 insurance claim, 50/50 Liability Scenario

Question
I was recently in a fender bender accident on private property. Security from the school, where the accident occurred, came out to assess the situation. No major damages were done, only scratches to my vehicle...none to the other party.  Our insurance is now stating that it will result in a 50/50 claim.  What does that mean? And also, the car that I was in this particular accident has since been involved in an additional accident in which the vehicle was totaled.

Answer
Sorry for the delay.

Okay, so a 50/50 claim means that both parties are claiming that the other is at fault, but there is no witness and no evidence to prove who is telling the truth and who really is at fault.  If the company can't figure it out, then both people take half the blame.  In most cases, when taking half of the blame, you have to pay for half of the other person's damages.  You can probably get half of your deductible back, but it also depends on what state this occurred in.
